My client was brought under investigation for departmental violations in relation to charges of Assault Family Violence. The accuser did not want to press charges. However, that does not prevent the prosecution from moving forward with the case. Both my client and the accuser had been drinking heavily prior to the police being called out.
The criminal case resulted in a deferred prosecution agreement which, upon successful completion and after the statute of limitations runs out, results in a permanent dismissal of the charge and the ability to expunge the entire record.
Outcome
While indefinite suspension (firing) was a strong possibility at the outset of representation, the administrative investigation resulted in an agreed 30-day suspension to include inpatient counseling, during which my client was able to utilize employment benefits to cover the cost of treatment.
